## 4. Quotes and Estimates
- All quotes are valid for 30 days unless otherwise specified
- Quotes may be subject to change if project requirements change
- Additional costs may apply for variations to agreed scope
- GST is included in all quoted prices unless otherwise stated
## 5. Project Execution
### 5.1 Timeframes
- Project timeframes are estimates and may vary due to factors including:
- Weather conditions
- Material availability
- Council processes
- Site access
- Unforeseen circumstances
### 5.2 Site Access
- Clients must provide reasonable access to the construction site
- Sites must be safe and clear of obstacles
- Any access limitations must be communicated before project commencement
## 6. Payment Terms
- Payment schedules will be outlined in individual contracts
- Progress payments may be required for larger projects
- Final payment is due upon project completion
- Late payments may incur additional fees
- We reserve the right to suspend work if payments are overdue
## 7. Warranties and Guarantees
We provide warranties in accordance with:
- Building Act 2004
- Consumer Guarantees Act 1993
- Construction Contracts Act 2002
## 8. Intellectual Property
- All designs, plans, and documents created by Verco Construction remain our intellectual property
- These may not be reproduced without our written consent
- Photos of completed projects may be used for our marketing purposes
## 9. Liability
### 9.1 Insurance
- We maintain appropriate professional indemnity and public liability insurance coverage
- Clients must maintain appropriate insurance for their property during construction
- Contractors and subcontractors must provide proof of current insurance before commencing work
### 9.2 Limitations
Our liability is limited to:
- The scope of work detailed in the signed contract
- Direct losses caused by our negligence
- Obligations under New Zealand consumer protection laws
We are not liable for:
- Indirect or consequential losses
- Delays due to factors beyond our control (force majeure)
- Damage caused by client actions or decisions
- Issues arising from undisclosed site conditions
- Pre-existing building conditions not visible during initial inspection
- Losses resulting from client-supplied materials or specifications
- Economic loss beyond the contract value
### 9.3 Client Responsibilities
Clients must:
- Disclose all known site hazards and conditions
- Obtain necessary permits and consents
- Ensure accuracy of supplied information
- Follow our safety instructions when visiting sites
- Report any concerns promptly and in writing
### 9.4 Claims Process
- All claims must be submitted in writing within 7 days of discovery
- Claims must include detailed description and supporting evidence
- We will respond to claims within 14 working days
- Resolution will follow our dispute resolution process if needed
## 10. Dispute Resolution
- We aim to resolve disputes through direct negotiation
- If necessary, disputes will be handled through mediation
- Legal proceedings will be governed by New Zealand law
## 11. Termination
- Either party may terminate services with written notice as per individual contracts
- Termination fees may apply
- Clients remain liable for work completed
## 12. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website.
## 13. Governing Law
These Terms are governed by New Zealand law and the jurisdiction of New Zealand courts.
